Terms of Service
Use of all services from Virgo Internet Services Ltd. (hereafter referred to as "Virgo Hosting") constitutes agreement to these terms. Our full address is as follows;

1. Account Setups
Your account will be setup after we have received payment and we and/or our payment partner(s) have checked the transaction against fraud.
Providing us with an email address that is not at the domain name you're signing up under, is your responsibility. Your primary email address on file will be used in case we need to contact you and it's your responsibility to ensure that the email address on file is current and accessible.
Providing false contact information may result in the termination of your account and services.
In high risk transactions, you may be asked to provide government issued identification and a scan of the credit card used for the order. In case you fail to meet these requirements, the purchase may be considered as fraudulent and be denied.
For clients who require inbound account transfers, Virgo Hosting support team will make every effort helping you transfer your site to our servers. However, due to the nature of this service, successful transfers cannot be guaranteed. You can be assured that as Virgo Hosting, we'll try our best.
2. Content Hosted on Virgo Servers
All services provided by Virgo Hosting may only be used for lawful purposes. The customer agrees to indemnify and hold Virgo Hosting harmless from any claims resulting from the use of our services.
Using our services to to take away or limit the rights of any copyright or trademark is strictly prohibited. Your offering of sale of any merchandise of a copyright or trademark holder will result in termination of your account and services.
Virgo Hosting reserves the right to refuse service to anyone.
If any material on your account, in our judgment not found acceptable, your account may be terminated with or without prior notice. The following are examples of unacceptable material on all shared and reseller hosting accounts;
In case of failure to respond to our support department's abuse related emails within 24 hours may result in the suspension or termination of your account and/or services. All abuse related emails must be responded to with 24 hours.
Abuse of services and violations will be reported to the appropriate law enforcement agency.
Regardless of the installation method, it's your responsibility to ensure that programs/scripts intalled on your account are secure and directory permissions are set properly. We recommend setting directory permissions to 755 wherever possible.
You are ultimately reponsible for any and all actions taken under your account, including compromise of login credentials like usenames and passwords.
3. Virgo's Zero Tolerance Spam Policy
Virgo Hosting takes a zero tolerance stance against bulk emailing, spamming and sending unsolicited emails.
Mass mailing through Virgo Hosting servers in any shape and form, including safe lists and double opt-in mailing lists is strictly prohibited and will be treated as spam.
Accounts sending out spam mail will be terminated without notice.
Spamvertised websites (websites advertised via SPAM) may not be hosted on our servers. This provision is not limited to email spamming and includes, but is not limited to spam via fax, sms, instant messaging, usenet/newsgroups etc.
4. Pricing and Payments
Virgo Hosting reserves the right to change service prices at anytime.
You agree to supply full payment for the services received from Virgo Hosting.
Payments will be made in advance of the time period such services are provided.
You agree that unless you notify Virgo Hosting that you would like to cancel any service received, services will be renewed and billed on a recurring basis.
It's your responsibility to make sure that your payment information is up to date, and that all your invoices are paid on time.
Virgo Hosting's grace period for invoices is 7 days. Invoices that are overdue for over 7 days and not paid will result in your account and/or services being suspended until remaining balance has been paid in full.
5. Backups and Data Loss
Using Virgo Hosting's services is at your sole risk.
Virgo Hosting is not responsible of the files and data that is on your account.
Virgo Hosting provides many options for taking backups of your files and data, and it is your full responsibility to regularly take remote backups of your files and data residing on Virgo Hosting servers.
Virgo Hosting takes local and remote account backups regularly for intra-firm use only.
Suspended accounts do not get backed-up and with each backup cycle, previous backups get deleted.
You agree that you should not trust Virgo Hosting's backups for your own data security.
6. Cancellations and Refunds
Virgo Hosting reserves the right to cancel accounts and/or services at any time with or without prior notice.
Cancellation requests must be done in writing through the cancellation form provided in Virgo Hosting Client Portal.
Once Virgo Hosting receives your cancellation request, your request will be confirmed via email and your services will be cancelled. You will also be notified when the cancellation is done via email.
Virgo Hosting provides a 30 day money back guarantee on shared and reseller hosting accounts. You agree that this is not an unconditional money back guarantee.
Only first-time accounts are eligible for this 30 day money back guarantee. If you've had an account with Virgo Hosting before, cancelled your account and signed up with Virgo Hosting again, you will not be eligible for a refund.
There are no refunds on domain name purchases, SSL/TLS certificate purchases, software license purchases, administrative fees and setup/installation fees.
Refund requests must be done in writing and in the first 30 days of your service period.
Violations of Virgo Hosting Terms of Service will waive the refund policy.
7. Resource Usage Limits
A Virgo Hosting user may not:
Use of more than 50,000 inodes. The inode is a data structure in our Linux file systems and every file and directory on your account describes a file system object, which is 1 inode.
Use over 25% of any of the system's processing power, memory or disk i/o resources for longer than 60 seconds.
Run any stand-alone, unattended server-side processes such as IRC deamons.
Run any type of indexer or web spider.
Run any type of software that connects to/works with an IRC (Internet Relay Chat) network.
Run any type of torrent application, client, tracker or website.
Run any type of software to use the account as a file storage/backup repository or download website.
Run any type of software or website that participates in file-sharing/peer-to-peer activities
Run any type of gaming servers
Run any cron job with intervals of less than 15 minutes
8. Reseller Accounts
Reseller accounts are limited by disk space and monthly bandwidth usage. These limits vary depending on the hosting package purchased. If your account passes these limits, Virgo Hosting reserves the right to suspend the account until the start of the next allocation or until the account is upgraded to a hosting plan with higher limits.
Unused bandwidth in one month can't be carried over to the next month.
Resellers are responsible for supporting their own clients and clients of resellers should not contact Virgo Hosting for support. If a reseller's client contacts Virgo Hosting, we reserve the right to suspend the client account until the reseller assumes responsibility for the client. Support requests must be made by the reseller on their clients' behalf.
Resellers are responsible for content stored and/or transmitted under their reseller account and their client accounts. Resellers will be held responsible for their clients' actions that violate Virgo Hosting terms of service, or the law.
9. Shared (Non-Reseller) Accounts
Shared accounts may not resell web hosting, if you'd like to resell hosting, you must use a reseller account.
You agree that you shall indemnify, defend, save and hold Virgo Hosting harmless from any and all losses, demands, costs, liabilities and claims.
You agree that this includes attorney fees asserted against Virgo Hosting, Virgo Hosting agents, customers, employees and officers.
You agree that you shall indemnify, defend, save and hold Virgo Hosting harmless from any and all liabilities arising out of;
Any injury to a person or property caused by any services provided or otherwise sold in connection with Virgo Hosting.
Any material hosted on Virgo Hosting servers by the customer infringing or allegedly infringing on the rights of a third party.
Any copyright infringement and any defective products sold through any Virgo Hosting server.
Virgo Hosting shall not be responsible for any damages you or your business may suffer.
Virgo Hosting makes no expressed or implied warranties of any kind for services we provide.
12. Disclosure to Law Enforcement
Upon lawful request from government agencies, Virgo Hosting will fully cooperate and may disclose any customer information to law enforcement agencies without consent or notification to the customer.
16. Changes to the Terms of Service
Virgo Hosting reserves the right to make changes to the Virgo Hosting Terms of Service at any time without prior notice.
